Terms of Service

Please read these Terms of Service (“Terms”) carefully before using TheCardDesk.com (the “Site”) or any services offered by The Card Desk LLC, a Delaware limited liability company d/b/a “The Card Desk” (“The Card Desk,” “we,” “us,” or “our”).

By accessing or using our Site, creating an account, subscribing to our newsletter or a paid plan, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Site or services.

1. About The Card Desk

The Card Desk is owned and operated by The Card Desk LLC, a Delaware limited liability company. The Card Desk is a market-data and media platform for Marvel trading card collectibles. We provide card valuations and sales data built on recorded public sales, collection (portfolio) tracking tools, a free weekly market newsletter, and content across YouTube and other platforms.

We do not sell trading cards on this Site.Card listings displayed on the Site link to third-party marketplaces (principally eBay), where any purchase occurs between you and the third-party seller. The only product sold directly on this Site is our paid subscription (“Pro”).

The Card Desk is not affiliated with Marvel Entertainment, LLC, Disney, Upper Deck, Topps, or any other card manufacturer or intellectual property holder.

2. Eligibility

You must be at least 18 years of age to create an account or purchase a subscription. By using our Site, you represent and warrant that you meet this requirement. If you are under 18, you may browse the Site only with the involvement of a parent or legal guardian.

3. Accounts

You may create an account to access certain features (including portfolio tracking and paid features). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. Authentication is provided by our identity service provider (currently Clerk).

We may suspend or terminate accounts that violate these Terms.

4. Subscriptions (Pro)

Plans and Billing

We offer a free tier and a paid “Pro” subscription, currently priced at $15 per month or $150 per year (prices subject to change; current pricing is displayed at TheCardDesk.com/upgrade). Payments are processed securely by Stripe. We do not store your full payment card information.

Automatic Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annual) until canceled. By subscribing, you authorize recurring charges to your payment method.

Cancellation

You may cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain Pro access until then. See our Billing & Refund Policy for refund terms.

Price Changes

If we change subscription pricing, we will provide at least 30 days’ notice. Price changes apply to new billing periods after notice; we will not retroactively change what you have already paid.

Failed Payments

If a renewal payment fails, we may retry the charge. If payment cannot be collected, your account will be downgraded to the free tier at the end of the paid period. Your portfolio data is retained and restored upon resubscription.

5. Market Data, Valuations, and Tools

Nature of the Service

Our valuations, trends, grade-check estimates, and related tools are statistical estimates derived from recorded public sales data. They are provided for informational purposes only and are not appraisals, offers to buy or sell, or financial advice. Values shown may differ materially from what any card actually sells for. See our full Financial Disclaimer.

No Advice

Marvel trading cards are collectibles, not securities. Nothing on this Site constitutes financial, investment, tax, or legal advice, and The Card Desk is not a registered investment advisor or broker-dealer.

Data Accuracy

We work to keep our data accurate and current (updated nightly), but we do not warrant that any data point is complete, accurate, or timely. Third-party data sources may contain errors we cannot control.

Your Portfolio Data

You retain ownership of the collection information you enter into the portfolio tool. You grant us a limited license to store and process it to provide the service (including computing valuations and aggregate, de-identified statistics).

6. Third-Party Marketplace Listings (eBay)

Card listings displayed on our Site are sourced from third-party marketplaces, principally eBay, and link out to those marketplaces. The Card Desk is not the seller, is not a party to any transaction between you and a third-party seller, and does not take possession of, inspect, authenticate, or guarantee any item listed.All purchases are governed by the third-party marketplace’s terms, policies, and buyer protections — not ours.

Listing information (price, condition, images, availability) is provided by third-party sellers and may be inaccurate or out of date by the time you view it. Always verify the listing on the marketplace before purchasing.

Affiliate Disclosure

The Card Desk may participate in affiliate programs, including the eBay Partner Network. If you click a listing link on our Site and make a purchase, we may earn a commission at no additional cost to you. This does not influence which listings are displayed or how cards are valued.

7. Newsletter and Content

Newsletter

Our newsletter is provided free of charge. You may unsubscribe at any time using the link in any email.

Intellectual Property

All content published by The Card Desk — including text, data compilations, valuations, graphics, logos, and video — is owned by or licensed to The Card Desk and protected by copyright and other intellectual property laws. You may not reproduce, redistribute, resell, or create derivative works from our content or data without prior written permission. You may share links and quote brief excerpts with attribution.

No Endorsement

References or links to third-party products, platforms, or services do not constitute endorsement.

8. User Conduct

By using our Site, you agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site, other users’ accounts, or our systems
• Use automated tools (bots, scrapers, crawlers) to access, extract, or harvest Site content or data without written permission
• Circumvent, or attempt to circumvent, usage limits, paywalls, or access controls
• Resell, sublicense, or systematically redistribute our data or valuations
• Impersonate The Card Desk or any other person or entity
• Engage in any activity that could damage, disable, or impair the Site

9. Third-Party Platforms

Our Site integrates with or links to third-party platforms including Clerk (authentication), Stripe (payments), Vercel (hosting), Beehiiv (newsletter), YouTube, Instagram, Whatnot, and eBay. Your use of these platforms is subject to their own terms and privacy policies. The Card Desk is not responsible for the practices of any third-party platform.

10. Disclaimer of Warranties

THE CARD DESK AND ALL CONTENT, DATA, TOOLS, AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE, THAT ANY DATA OR VALUATION IS ACCURATE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CARD DESK LLC AND ITS MEMBERS, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SITE, CONTENT, DATA, OR SERVICES — INCLUDING BUT NOT LIMITED TO LOSSES RESULTING FROM RELIANCE ON ANY MARKET DATA, PRICE ESTIMATES, OR RECOMMENDATIONS, OR FROM ANY TRANSACTION WITH A THIRD-PARTY MARKETPLACE OR SELLER REACHED THROUGH OUR SITE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Card Desk LLC and its members, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of our Site, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of our Site shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in Douglas County, Colorado under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our Site with a new effective date. Your continued use of the Site after any update constitutes your acceptance of the revised Terms.

15. Termination

We reserve the right to terminate or suspend your access to our Site and services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination for cause, no refund is owed except as required by law.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, Financial Disclaimer, and Billing & Refund Policy, constitute the entire agreement between you and The Card Desk regarding your use of our Site and services.
